These Terms and Conditions govern your use of services provided by Luminous Tours, operated by Arnel Garcia ("we," "our," "us"). By booking a tour or mentorship session, you agree to these terms.

1. Booking and Payment

All bookings are confirmed via email. Full payment is required to secure your session. Prices are listed in USD. Luminous Tours reserves the right to adjust pricing for future bookings with reasonable notice.

2. Cancellation and Refund Policy

Photography Tours

Cancellations made 7 or more days before your scheduled session will receive a 90% refund. Cancellations made within 7 days of the session are non-refundable. Rescheduling within 7 days of the session is subject to availability and is at Luminous Tours' discretion.

If Luminous Tours cancels a session due to unsafe conditions, illness, or other circumstances beyond our control, you will receive a full refund or the option to reschedule at no additional cost.

Online Mentorship Sessions

Please give at least 24 hours' notice if you need to reschedule or cancel an online mentorship session. Sessions cancelled with less than 24 hours' notice may not be eligible for a refund and are at Luminous Tours' discretion. If Luminous Tours needs to cancel or reschedule a session, you will receive a full refund or the option to reschedule at no additional cost.

3. Conduct and Participation

All participants must behave respectfully toward the guide and other members of the public at tour locations. Luminous Tours reserves the right to terminate a session without refund if a participant's behavior is unsafe, disrespectful, or in violation of applicable laws.

4. Photography and Intellectual Property

All photographs taken by you during a tour are yours. Arnel Garcia will not claim ownership of images produced on your camera or device. We may request permission to share images you create during a tour on our website or social media with appropriate credit to you. This is always optional and requires your explicit consent.

All images created by Arnel Garcia, including those shared in marketing materials, on the website, and during tours, are the intellectual property of Arnel Garcia and Luminous Tours. Reproduction without written permission is prohibited.

5. Liability

Photography tours take place in outdoor coastal environments that may involve uneven terrain, wet surfaces, and variable weather conditions. Participation is at your own risk. Luminous Tours accepts no liability for personal injury, loss, or damage to equipment during tours. Participants are encouraged to ensure their own personal and equipment insurance is adequate.

In no event shall Luminous Tours be liable for indirect, incidental, or consequential damages arising from participation in any tour or mentorship service.

6. Intellectual Property of Website

All content on luminous.tours — including text, photographs, design, and code — is owned by Arnel Garcia and Luminous Tours. Reproduction in any form requires written permission.

7. Privacy

We collect only the information necessary to provide our services. See our Privacy Policy for details.

8. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes will be resolved in the courts of San Diego County, California.

9. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services after any changes constitutes acceptance of the revised Terms.
